Personally, I would avoid dealing with a SELLER who gives himself/herself these types of "outs":
1. I WAS TOLD IT IS JOHNNY WEST HORSE. YOU DECIDE.
2. Please do not hold me responsible due to my lack of knowledge and what my eyes might have missed.
3. A NO RETURN policy is, generally, a "red flag" for me. (Having said that, there may be practical reasons for not accepting returns - e.g. return shipping too expensive for the monetary value of the item. Still, I would approach with caution.)

I would say a definite repaint. You can tell this was painted all over (see the scratches) and the Marx factory did not do that. If it was molded in that color that would be cool.

It's usefull for someone doing a custom. I would not bid much for it. Actually I am not bidding anything on it.
